Rules and Regulations
1. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW. MUST BE BETWEEN THE AGES OF 5 AND 16 TO ENTER. OPEN TO ALL COUNTRIES WHERE SWEEPSTAKES IS LEGAL. Please provide your entry to Animaland Sweepstakes, by completing the online entry form. Entries must be transmitted by 11:59 PM E.S.T. on September 30, 2006. By participating, each entrant accepts these rules.
2. Limit one entry per person.
3. Sweepstakes sponsors are not responsible for lost, late or misdirected entries. No telephone calls, postal mail, or facsimiles will be accepted regarding this sweepstakes.
4. Entries will not be acknowledged or returned.
5. Upon submission of entry, all rights (copyrights) to the content of the submission belong to Animaland, Inc. Author grants Animaland, Inc. perpetual, royalty-free, exclusive rights to edit, publish, make available, distribute, assign, sublicense or otherwise exploit the submission throughout the world by means of any media, whether now known or hereafter invented.
6. This sweepstakes is open to children 5 to 16 years old and older except the employees of the Animaland, the sponsors, their advertising agencies, suppliers and members of their immediate families.
7. Winners will be chosen no later than December 31, 2006. Winners will be notified by email and US mail. All winners and their legal guardians must sign returned the affidavit of eligibility within 30 days of its receipt. The odds of winning depend on the number of eligible entries received.
8. Only one Grand Prize and 10 Runners-Up Prizes will be awarded. Unclaimed prizes may not be awarded. The Winner of the Competition will be selected by a panel of at least three judges, who are professional writers and/or Animaland, Inc. executives (the "Judges"). The winning submission will be selected on the basis of criteria established by the Judges, which may include originality, style, relationship to Animaland Characters, and the decision of the Judges will be final. Submissions may be subject to initial review by persons other than the Judges based on criteria established by the Judges and/or the Sponsor, and no less than 15 submissions will be selected for final review by the Judges for selection of the Winner.
9. No substitutions in prizes or cash will be allowed. Sweepstakes sponsor reserve the right to substitute the prize with one of greater or equal value.
10. Liability for any applicable federal, state or other taxes will be the sole responsibility of the individual winner.
11. This sweepstakes is subject to all federal, state and local laws and regulations.
12. All stories must be written in English.
13. Entries must include consent by a legal guardian of the child entering the sweepstakes.
14 - By participating in the Competition, entrants agree to release and hold harmless the Sponsor, its officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Competition; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Competition or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Competition or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Competition, and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
15. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Nevada. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Released Parties in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Nevada.
16. GENERAL CONDITIONS: In the event that the operation, security, or administration of the Competition is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Competition to address the impairment and then resume the Competition in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prize to the best submission from the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any emailed entry, the Authorized Account Holder of e-mail address used to enter will be deemed the entrant. The Authorized Account Holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain name associated with the submitted e-mail address.
17. PUBLICITY: Except where prohibited, participation in the Competition constitutes Winner's consent to the Sponsor's use of Winner's name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
